FITOPOLIS Terms of Use

1. In short

• FITOPOLIS is an app in which a personal trainer coaches their trainees: meal plan, workouts, weigh-ins, meetings and chat.
• The app is in a pilot. It is free, and it may have faults.
• It is only a tool. The meal plan and the workouts come from the trainer, not from us, and nothing in it is medical advice.
• The trainer and the trainee agree between themselves on the coaching and the payment. We are not a party to that, and the app does not move money.
• What you record and send belongs to you, and you are responsible for it.
• You can stop and delete your account at any time.

2. Who we are

By signing in to and using the app, you agree to these terms and to the Privacy Policy. If you do not agree, do not use the app.

3. Who may use it

• A trainer must be 18 or older. A trainer who works with trainees is responsible for holding any licence, certification or insurance the law requires for their work.
• A trainee must be 13 or older. The app may not be used under 13.
• A trainee aged 13 to 17 joins only with the consent of a parent or guardian. Obtaining that consent is the trainer's responsibility. When a trainer adds a client under 18, they confirm in the app that they have received such consent. A trainer who confirms without having received consent is in breach of these terms.
• During the pilot the app is open only to invited people, on Android, through Google Play's testing track.

4. Your account

• You sign in with an Israeli phone number and a code sent by SMS. Each number is one account.
• Use only your own number. Do not sign in with someone else's.
• Whoever holds your phone can get into your account. Keep your phone locked, and sign out on a phone you hand to someone else.
• If you change your number, write to us and we will move the account to the new number (Privacy Policy, section 3.5).

5. The pilot

• The app is in a pilot: an early version we are testing with the first trainers and trainees. Things will change, parts will be added, and there may be faults.
• We do everything we can so that data is not lost, but during the pilot do not rely on the app as the only place for an important record. A trainer who tracks payments in it should keep a copy elsewhere too.
• Use during the pilot is free. If that changes, we will tell you in advance, and no one will be charged without agreeing to it themselves.
• We want to hear what does not work and what is missing, through "Contact the team" in the app or by email.
• We may end the pilot. If we do, we will tell you in advance and explain what happens to the data.

6. Health — the app is a tool, not advice

• The meal plan, the workout plan and any recommendation in the app come from your trainer. We do not write them, check them or take responsibility for them.
• FITOPOLIS does not give medical, nutritional or therapeutic advice, and does not replace a doctor or dietitian.
• Before starting a workout or nutrition plan, especially if you have a medical condition, are pregnant, are injured or have an eating disorder, consult a doctor.
• If something feels wrong during a workout, stop and get help. In an emergency in Israel, call Magen David Adom, 101.
• The numbers in the app, such as calories, weight and workout volume, are only an aid to tracking and may contain errors.

7. Trainer and trainee

• The trainer does not work for us. They are independent and use FITOPOLIS to work with their trainees.
• The agreement on the coaching — what it includes, what it costs and how it is paid — is between the trainer and the trainee. We are not a party to it.
• The app does not charge or move money. Its payment tracking is the trainer's own record. A dispute about payment is settled between you.
• The trainer may end the coaching, archive a trainee or delete them. What then happens to the data is set out in the Privacy Policy, sections 3.12 and 11.
• Trainers: you receive your trainees' data in order to coach them, and only for that. Do not pass it on and do not use it for any other purpose. When you write private notes about a trainee, write only what the coaching needs.

8. What you record and send

• What you record, write, photograph, record and send in the app belongs to you.
• You give us permission to store it, carry it between phones and show it to whoever is meant to see it (Privacy Policy, section 5), only so that the app works. That permission ends when you delete what you sent or your account, except for what the Privacy Policy says remains.
• You are responsible for what you send. Send only what you are allowed to: do not send a photo, video or recording of another person without their permission, and do not send material whose copyright belongs to someone else.
• In the chat you can edit and delete your own message during the first 45 minutes. After that it stays. What the other side has already seen, they have seen, and if they kept a copy, that is beyond our control.
• When you attach a screenshot to a message to us, attach only what we need in order to understand. On a trainer's phone, such an image can show details of their clients.

9. What is not allowed

• Harassing, threatening, insulting or frightening anyone, in the chat or anywhere else in the app.
• Sending offensive, sexual, violent or illegal content — and never sexual content where either side is under 18.
• Impersonating someone else, or getting into an account that is not yours.
• Passing an invitation code to someone it was not meant for, or using a code not meant for you.
• Trying to get around the protections of the app or the server, reach someone else's data, overload the server or harvest data from it automatically.
• Using the app for advertising, marketing or unsolicited messages.
• Using it against the law.

10. Suspension and closing

• You can stop using the app and delete your account at any time, from the account area (Privacy Policy, section 11).
• If you breach these terms, we may suspend or close your account. Where possible we will tell you first and explain why. In a serious case, such as harm to a minor or an attempt to break in, we will act at once and, where needed, report to the authorities.
• Every such action on an account is taken with the approval of a person on our team.

11. What belongs to us

The FITOPOLIS name, the logo, the design and the code of the app belong to us. You receive a personal permission to use the app as intended, and nothing more. Do not copy it, sell it or build another app from it.

12. Liability

• The app is provided as it is, as a pilot version. We do not promise that it will always work, without faults or interruptions.
• We are not responsible for what the trainer gives or recommends, for the coaching itself, for payments between trainer and trainee, or for what another user sends.
• We are not responsible for indirect loss, such as loss of income. Where we are responsible for a loss, our liability is limited as far as the law allows.
• Nothing in these terms limits any liability that the law does not allow to be limited, or takes away rights the law gives you.
• If you breach these terms and that causes us loss — for example, a claim by someone else over something you sent — you are responsible for that loss.

13. Changes to these terms

If we change these terms, we will update the date at the top and describe the change in the Google Play update notes. A change that is to your disadvantage we will also announce in advance inside the app. If you do not agree to a change, you can delete your account. If you keep using the app after a change takes effect, that means you have accepted it.

14. Law

These terms are governed by the law of the State of Israel, and any dispute about them will be heard only in the competent courts in Israel. Before going to court, write to us and we will try to resolve it together.
